The barbarity I was referring to was the fact that every time we see someone on trial in US courts they appear in leg irons and hand cuffs. Even that young English au pair a few years ago had to shuffle because of the irons she had to wear.
That plus the death penalty of course. |

Littlestar- Yep, most people don't have a clue about the Ghost Dance- what it REALLY means or what is involved (or, as I've been told, that it is STILL against the law.) That last I'm not absolutely sure about, although I DO know it was against the law until '80- same as our practices.
Any vestige of the Square Ground had to be kept hidden until the last couple of decades. Some of my elders relate how they were threatened by Georgia officials- if they created any problems, they would get one-way bus tickets to Oklahoma (The Trail of Tears law was repealed in 1980-81, and not over a hundred years ago like some politicians tried to mislead people into believing). I've been told of families that are still in hiding- they think that the recent change in the laws is just a trick to get our people to come out of hiding, so we all can be exiled or killed.
I can also argue that there still is two (or more) legal systems in the US. There are a large number of laws that impact Native Americans, but not people of European descent (unless those Native Americans assimilate). Feather laws, artifact laws, and so on directly impact our culture but not the dominant one.
I KNOW people who have run afoul of these laws! |

That plus the death penalty of course. |
There have been cases where the cuffs, etc., weren't used, and the defendant wrestled a gun away from a security officier, and shot several people. I think it would be hard to insist that only some people be restrained, so I imagine they pretty much have to restrain everyone.
I think this is used mainly for arraignment, and not formal trial, but I could be wrong. ??
And that sweet little au pair was a murderer....... |

That case was viewed very differently over here. Here she wouldn't have been charged with murder which implies malice aforethought, instead she would have faced a charge of manslaughter.
Whatever she had been charged with, no civilised country would have thought it necessary to put a frightened 19 year old in leg irons so she couldn't walk properly. That shuffling gait even makes someone look more guilty. |

This PC crap is getting people killed.
You may remember the case in Atlanta. If not
http://www.hubdub.com/m10885/Will_Atlan ... _of_Murder
They had a small female escorting a six foot plus 200lbs plus
man to court.......... why?
He simply overpowered her, took her gun, killed the judge, a court
reported and a sheriff's deputy.
The authorities have promised to change their procedures so
this won't happen again.
A year later, one of the Atlanta TV stations sent people back in
to interview the people who work at the exact same courthouse,
the verdict from the people who work there...nothing has changed,
it could happen again tomorrow
They(no, you the taxpayer) have spent $millions$ on an "open and shut" case that
hasn't even started yet |

Well, like Gornman brought up, we have had times when people who were not restrained "took advantage of the fact", and people died. But, you can't pick and choose who you restrain. Can we really say, well, this one prisoner is a pretty young white girl, so let's let not restrain her, but this prisoner is a large black man, so let's restrain him? Then, it becomes racist. You either have to restrain everyone, or no one. |
